Can influencers operate under a company license in Dubai?

Dubai has become one of the most attractive cities in the world for content creators. Low taxes, a thriving brand ecosystem, and a central time zone that spans both Eastern and Western markets have made the emirate a natural base for influencers building serious commercial careers. But operating here legally is not as simple as posting content and collecting payments.

If you are a creator considering business setup in Dubai, the rules have changed significantly — and understanding the two-layer compliance structure now in place is essential before you take on a single paid campaign.

The Two-Layer Compliance Structure Every Influencer Needs to Know

The starting point for any influencer operating in the UAE is Federal Decree-Law No. 55 of 2023, the country’s first major media law overhaul in over four decades. Under this legislation, promotional content published on social media is formally classified as a commercial advertising activity. Cabinet Resolution No. 20 of 2025 then translated that classification into a practical compliance framework — and it operates across two distinct layers that work together.

The first layer is a valid company trade license issued by a UAE mainland authority or free zone. This is the commercial foundation of your operation. It is the legal entity through which you sign brand contracts, issue invoices, receive payments, open a corporate bank account, and sponsor your own UAE residence visa. Without it, you have no legal standing to conduct commercial activity in the country.

The second layer is an Advertiser Permit from the UAE Media Council. This is the content authorisation — the document that permits you to publish promotional posts on any platform, whether paid, gifted, or affiliate-based, regardless of your follower count. The permit is applied for and issued to you as an individual. It is linked to your registered social media accounts, and you are required to display your permit number on your profiles.

Here is where creators most commonly go wrong: they assume the company license covers everything. It does not. The trade license is a legal prerequisite for applying for the Advertiser Permit — you cannot get the permit without it — but once issued, the permit exists as a separate personal authorisation. Two creators operating under the same company each need their own permit. A social media manager employed by your company who publishes sponsored content also needs their own permit. The two instruments are entirely distinct.

There is one narrow exemption. If you use your personal accounts exclusively to promote your own company’s products or services, the Advertiser Permit is not required. But the moment any third-party brand work enters the picture — paid posts, gifted collaborations, affiliate arrangements — that exemption falls away and both layers become mandatory.

On costs: the Advertiser Permit is free for the first three years for UAE residents, after which the annual fee is AED 1,000. It renews annually through the UAE Media Council’s online portal. Enforcement under Cabinet Resolution No. 42 of 2025 became fully active on 31 January 2026. Publishing promotional content without a valid permit carries fines starting at AED 10,000 for a first offence, escalating to AED 1 million for serious or repeat violations. An expired permit accrues AED 150 per day up to a cap of AED 3,000. Holding a valid company license does not shield you from Advertiser Permit violations — they carry entirely separate penalty structures.

Company License vs. Freelance Permit — Which Structure Is Right for You?

Both a full company license and a freelance permit satisfy the trade license prerequisite for the Advertiser Permit application. The structural question is really about what your operation looks like beyond basic compliance — and the differences are substantial.

A freelance permit is issued in your personal name and covers a defined range of professional activities. It allows you to invoice clients and supports a UAE residence visa. For very early-stage creators with modest revenue and no immediate plans to hire, it is the lower-cost entry point.

A company license, by contrast, creates a limited liability entity. Your personal assets are legally separated from your business liabilities. You operate under a registered trade name, which matters when signing with enterprise brands or agencies that require formal vendor registration. Corporate banking access is considerably stronger: multi-currency accounts, merchant services, and business credit are all far more accessible under a company structure.

The visa economics shift materially too. A company license can support multiple investor or employee visas — useful the moment you want to bring in an editor, manager, or business partner. A freelance permit is generally limited to personal residency and immediate family dependants.

Choosing the Right Activity Codes and Getting Your Permit in Order

Selecting the right business activities on your trade license is a compliance decision, not just a paperwork formality. The UAE Media Council cross-references your registered activities when assessing your Advertiser Permit application. If your licensed activities do not match what you are actually doing commercially, you risk having your permit application flagged or your license deemed non-compliant.

For most influencers and content creators, three activity codes cover the core of the business: Social Media Services (7310.16), Marketing Services via Social Media (6202.99), and Digital Content Management (7020.12). If your work extends into brand consulting, production, or marketing services for other clients, those activities need to be listed on the license too.

Most free zone company licenses allow up to three activity groups, which covers the majority of creator-led business models. Getting this right at setup avoids the more expensive problem of amending activities mid-operation.

Once your license is in place, the Advertiser Permit application goes through the UAE Media Council’s digital portal at eservices.uaemc.gov.ae. The full journey from license to permit can move in a matter of days, provided all documentation is in order. After that, your Emirates ID, corporate bank account, and visa sponsorship can follow in sequence.

The compliance position is clear: you either hold both a valid company license and a valid Advertiser Permit, or you are exposed. There is no middle ground, and the grace period for existing UAE-based creators ended in January 2026. For influencers building long-term commercial careers in Dubai, getting the structure right from the start is not just a legal obligation — it is the foundation everything else is built on.
